BIGHORN RENTALS OF SUMMIT COUNTY, INC.
Check In/Out Times: Check in time is 4PM, mountain time on the day of arrival. Check out time is 10AM, mountain time on the day of departure. Early check in or late check out will only be allowed with prior consent of Bighorn Rentals staff. Bighorn Rentals reserves the right to charge guest $100 per hour for a late check out that has not been approved prior.
Payment/Cancellation Policy: For reservations made more than 30 days prior the arrival date, a non-refundable payment equal to 25% of the total lodging price is due at the time of booking. If booking 30 days or less from the arrival date, full payment is due at the time of booking. All payments are non-refundable when taken and all reservations are completely non-refundable 30 days prior to the arrival date. If total payment has been received and cancellation is made 30 days or less from the arrival date, all monies will be retained by Bighorn Rentals. If arrival date is changed for any reason, the earliest arrival date will be used in calculation of 30 day before arrival. If a credit card is used for payment, Guest authorizes Bighorn Rentals to charge any monies due under these terms and conditions to any credit card account provided by Guest. Guest also authorizes Bighorn Rentals to charge the balance due at 30 days prior to arrival with no notification to Guest.
Travel Insurance: Travel Insurance can be added to your reservation for an extra 6.95% of the reservation total. Travel Insurance will refund the reservation total back to Guest in the event of a cancellation in the non-refundable time period for a covered reason such as a medical emergency or weather related cancellation/delay. NO SMOKING: All properties managed by Bighorn Rentals are NON-SMOKING. Guest acknowledges smoking tobacco or marijuana on the premises is prohibited and agrees to pay $1000 for each violation of the smoking policy.
NO PETS: Dogs are only allowed in rental properties designated as allowing them, only when prearranged with Bighorn Rentals and only when a refundable pet deposit of $200 has been paid. No other type of pet is allowed in any of the rental properties. Guest agrees to pay $1000 for each violation of the pet policy.
Maximum Occupancy: The maximum number of guests per property is established and listed on our website at www.bighornrentals.com. Maximum occupancy limits are strictly enforced. If guest exceeds the maximum occupancy set for the property, Guest agrees to pay $250 per person, per night that the occupancy is above the maximum. Every property must have at least one Guest over the age of 25. Proof of age is required at check in.
Damage: A valid credit card is required prior to arrival. Guest agrees Bighorn Rentals will charge Guest credit card on file for any damage to the property beyond normal wear and tear, any contents missing from the property after check out, additional cleaning fees as result of Guest leaving the property unreasonably dirty, smoking in the property, allowing unauthorized pets in the property, exceeding the maximum occupancy of the property and any charges accrued by Guest not paid prior to departure.
Damage Waiver: Your reservation includes our Accidental Damage Protection Fee designed to cover unintentional damage to the rental unit interior that occurs during your stay provided damage is disclosed to management prior to check-out. The fee covers a maximum benefit of $1,500. Any damages that exceed $1500. or are not covered under this protection will be charged to the credit card on file. Guest agrees to be responsible and provide payment for any intentional damage to the rental unit; or unintentional damage exceeding $1,500 that may occur during their stay. This damage or loss, if any, may be applied to guest's Credit Card if no other arrangements have been made. This fee does not cover missing keys, garage door openers and parking passes, unauthorized pets or smoking damage in non-smoking properties nor violations of any other parts of the rental agreement.
Exception to Damage Waiver: If Guest does not wish to take advantage of Accidental Damage Protection Fee, Guest may pay a $1500 refundable damage deposit by cash or check only, before arrival date. Unused damage deposits will be refunded within 14 days of departure pending no damages as discussed above. Bighorn Rentals reserves the right to use the damage deposit for any unpaid charges and fees at the time of check out.
House Rules: All occupants must observe and abide by any posted or documented rules or instructions including homeowner or condominium association declarations and bylaws. Copies of these documents can be provided upon request. While using the property, Guest will abide by all applicable governmental laws and regulations. Properties are not to be used as formal entertainment facilities (such as weddings/receptions, large family reunions, etc.). Any Guest that disturbs the peace of neighboring properties with excessive noise, misplaced trash or parking an excessive amount of vehicles agrees to pay $500 for each violation. Telephone service is not maintained in every property. Bighorn Rentals and property owner are not responsible for any damages resulting therefrom.
Inspection: Bighorn Rentals reserves the right to enter the property during guest occupancy for inspection purposes to ensure all terms of this agreement are being met.
Falsified Reservations/Guest Responsibility: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. Bighorn Rentals and the property owner reserve the right to refuse service to anyone for good cause and will not be responsible for accident or injury to guest or for loss of personal property or valuables of any kind. Guest agrees to waive any liability and to hold harmless Bighorn Rentals and the property owner for any injury or property loss that Guest may suffer or incur during his/her stay at the property. Guest further agrees to indemnify Bighorn Rentals and the property owner, including reasonable attorney fees and costs, for any damages sustained by Guest as a result of Guest's use of the property.
Venue: This Agreement is made under and is to be enforced in accordance with the laws of the State of Colorado. Venue for any action to enforce this Agreement shall be in Summit County, Colorado. The prevailing party in any action to enforce the terms of this Agreement shall be entitled to an award of its attorney's fees and cost from the other party or parties.
